Minneapolis was the nation\u2019s first city to pass trans-inclusive civil rights protection in the 1970s, and Minnesota was the first state to do so, in 1993.<\/p>\n<p>\u201cIn the nearly half-century since that landmark legislation, transgender rights have moved forward but they have also faced a significant backlash both locally and globally,\u201d according to the class syllabus. \u201cThis course examines these two competing trajectories.\u201d<\/p>\n<p>\u201cWe\u2019ve included speakers touching on all facets of the intersection of transgender rights and the law,\u201d said Tara Kalar \u201812, a human services judge at the Minnesota Department of Human Services and one of the course\u2019s instructors. \u201cWe\u2019re really giving the students a well-rounded perspective on transgender rights.\u201d<\/p>\n<p>To that end, the class recently heard from Judy Shepard, the mother of Matthew Shepard, a 21-year old gay college student who was beaten, tortured, and left to die in 1998 near Laramie, Wyo. He died six days later; his death helped spur the drive for civil rights for the LGBTQ community, especially around hate crimes legislation. Scott Dibble and state Rep. Athena Hollins, who are sponsoring <a href=\"https:\/\/www.revisor.mn.gov\/bills\/text.php?number=SF1512&amp;version=0&amp;session=ls92&amp;session_year=2021&amp;session_number=0\" target=\"_blank\" rel=\"noopener noreferrer\">legislation<\/a> this year to ban the use of a person\u2019s perceived or actual sexual orientation or gender identity as a defense for assaulting or murdering an LGBTQ person. Similar legislation recently passed in <a href=\"https:\/\/www.washingtonpost.com\/local\/lawmakers-approve-ban-on-gay-panic-defense-in-virginia\/2021\/02\/26\/0ab07a46-7883-11eb-9489-8f7dacd51e75_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">Virginia<\/a> and is often referred to as a \u201cgay panic defense ban.\u201d<\/p>\n<p>In the trial for the two men who killed Shepard, a defense lawyer claimed one attacker was driven to temporary insanity by alleged sexual advances from Shepard. Scott Dibble and Rep. Athena Hollins are sponsoring the gay panic defense ban bill.<\/p><\/div>\n<p>Rep. Hollins told the class she was 15 when Matthew Shepard was murdered, a time when she was debating whether to come out as bisexual to her family. \u201c[The murder] affected me so profoundly and made it real and scary,\u201d she said. \u201cAnd I can\u2019t believe we are still in this position where we have to fight to say that it\u2019s not okay to murder someone because you didn\u2019t realize their sexual orientation or gender.\u201d<\/p>\n<p>Sen. Dibble also recalled a vigil that drew more than 1,000 in the days after Shepard died. \u201dIt was a galvanizing moment,\u201d he said.<\/p>\n<p>The course is happening during a critical time for transgender law. The U.S. Supreme Court <a href=\"https:\/\/www.npr.org\/2020\/06\/15\/863498848\/supreme-court-delivers-major-victory-to-lgbtq-employees\" target=\"_blank\" rel=\"noopener noreferrer\">ruled last year<\/a> that protections in the 1964 Civil Rights Act do extend to discrimination against gay, lesbian, and transgender people. Congress is currently debating the <a href=\"https:\/\/www.cnn.com\/2021\/02\/25\/politics\/equality-act-passes-house\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Equality Act<\/a>, which would ensure those protections are extended beyond the purview of the Court\u2019s opinion. And President Biden<a href=\"https:\/\/apnews.com\/article\/biden-reverse-ban-transgender-military-f0ace4f9866e0ca0df021eba75b3af20\" target=\"_blank\" rel=\"noopener noreferrer\"> signed an order<\/a> early in his presidency to reverse a Trump-era policy that largely barred transgender people from serving in the military.<\/p>\n<p>\u201cWe do not grow up hearing our stories, or the stories we hear have been straightwashed,\u201d said Jonathan Long, a 3L blended-learning student from Texas who is in the class. \u201cIn the LGBT+ community, there\u2019s a strong focus on cisgender white gay men. Bisexuals are often erased from the narrative, and transgender people face not only erasure but active discrimination from other members of the LGBT+ community.\u201d<\/p>\n<p>Another student is Brenda Pfahnl, a 2L who hopes to practice immigration law and be an effective ally and advocate for transgender people. She\u2019s already worked on issues in clinics and in her clerkship \u201cwhere clients have faced persecution based on their gender identity. It\u2019s important to understand the social and legal issues that the LGBTQ+ community faces.\u201d<\/p>\n<p>In recent years, there has also been increased attention on violence perpetrated against transgender and gender non-conforming people. According to <a href=\"https:\/\/www.hrc.org\/resources\/fatal-violence-against-the-transgender-and-gender-non-conforming-community-in-2021\" target=\"_blank\" rel=\"noopener noreferrer\">Human Rights Watch<\/a>, at least nine transgender or gender non-conforming people have been killed so far in 2021.<\/p>\n<p>\u201cTransgender people, especially women and girls who are Black, have experienced epidemic levels of harassment, violence, and murder in the U.S. in the past several years,\u201d said Ellen Kennedy, the course\u2019s other instructor. \u201cThis course provides a context for understanding the targeting of this vulnerable minority in the U.S. and elsewhere and for opportunities to support legal redress.\u201d<\/p>\n<p>Kennedy and Kalar hope the course, titled \u201cTransgender Identity: Rights and Challenges Locally and Globally,\u201d can be offered annually.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Note:<\/strong> Ellen Kennedy, who is also executive director of World Without Genocide at Mitchell Hamline School of Law, cowrote <a href=\"https:\/\/www.startribune.com\/minnesota-must-ban-the-gay-panic-defense\/600029939\/?refresh=true\" target=\"_blank\" rel=\"noopener noreferrer\">this commentary<\/a> in the Star Tribune with Sen.
