Nature of Case: <\/strong><\/strong> The Appellant had previously been convicted of sexual assault and was required to register as a sex offender. He subsequently took a photograph of a child without obtaining parental consent, in violation of state law.<\/p>\n

The Appellant was arrested and convicted at a bench trial, and sought review of his conviction arguing that the statute at issue was unconstitutional both on its face and as-applied.<\/p>\n

Holding: <\/strong> The Illinois Court of Appeals affirmed the conviction, finding that the statute was not unconstitutional under the First Amendment.<\/p>\n<\/div>\n
