This is a family and family business dispute. The Nelsons are a wealthy family, due to the success of BoxAll, Inc., the company founded 50 years ago by the patriarch, Fred Nelson, who passed away 5 years ago. He was survived by his old spouse and two adult children, Keith and Dianne, all beneficiaries of the Nelson Family Trust and shareholders in BoxAll, Inc. The Trust’s holdings include the BoxAll shares, as well as considerable real estate assets. This dispute is between the siblings regarding distribution of profits and ownership. Phase one is initial client interviews; phase 2 is post initial interviews;phase 3 is preparation for second client meeting; phase 4 is the second lawyer-client meetings; phase 5 is “core concerns in a box”; phase 6 is “strategic interlude I (class discussion); and phase 6 is Strategic Interlude II (class discussion); phase 7 is Possible Settlement Process. Instructors could conduct a phase 8 negotiation or mediation (no additional materials provided).
