Religious freedom conflicts have taken an important front seat in First Amendment jurisprudence at both federal and state levels. With its recent Establishment and Free Exercise Clause decisions, the current U.S. Supreme Court is forging new paths on issues such as whether governmental acknowledgements of religion and funding of religious organizations are permissible under the Establishment Clause, and how to adjudicate conflicts between religious and sexual minorities. Meanwhile, adjudication under state constitutional principles in some states has added more protection for religious minorities.
This program will explore the current federal controversies over Religion Clause jurisprudence, including where rights collide; examine the historical role of the Minnesota Constitution in adjudicating both liberty rights and establishment limitations; and consider the future of both federal and state religious liberty clause decisions.
