The Supreme Court has recently sent cases related to Texas and Florida’s “moderators” laws back to the lower courts. These cases (NetChoice LLC v. Paxton, Moody v. NetChoice LLC) were the aftermath of the “moderators” laws that stated social media companies were not private spaces, so they could not moderate inflammatory speech. These laws were initially put in place in Texas and Florida after Donald Trump was removed from Facebook and Twitter in the aftermath of the January 6th attacks. The claim was that Facebook and other social media platforms should be treated like public spaces bound by the U.S. Constitution’s Freedom of Speech.
