United States v. Doby, No. 18-CR-40057 (D. Kan. 2019)
Nature of Case: Defendant was federally indicted for failure to register under federal SORNA, and filed a pre-trial motion to dismiss alleging, inter alia that federal SORNA constituted compelled speech, and thus violated his First Amendment rights.
Holding: Federal District Court for the District of Kansas denied Defendant’s Motion to Dismiss, rejecting all of his arguments. With respect to the compelled speech argument, the Court observed that to the extent federal SORNA compels speech, it survives a strict scrutiny analysis.
