People v. Suarez, No. 19-02190 (N.Y. App. Div. 2021).
Nature of Case: Petitioner was convicted as a youthful offender in New York and was sentenced to probation. Petitioner was subsequently incarcerated after violating the terms of his supervision. The New York Board of Parole imposed SARA restrictions onto Petitioner, which subjected him to a variety of housing and presence restrictions and delayed his release by two years.
Petitioner brought an action challenging the application of SARA restrictions to him, which was denied by the trial court. Petitioner sought review.
Holding: New York Appellate Division reversed the trial court, holding that New York’s legislature did not intend for SARA school grounds restrictions to apply to youthful offenders.
