Nature of Case: Plaintiff was convicted of sex offenses in the 1980’s and subsequent to his release from prison was required to register as a sex offender. Plaintiff brought a federal civil rights action challenging various aspects of Tennessee’s SORA on constitutional grounds, and moved for a preliminary injunction to have him removed from the registry.
Holding: The federal trial court granted Plaintiff’s motion for a preliminary injunction, finding that he demonstrated a high likelihood of success on the merits of the Ex Post Facto claim.
