Matthew 25 Ministries v. Swearingen, No. 18-cv–81738 (S.D. Fla. 2019)
Nature of Case: Organization brought federal civil rights action against Florida state officials, alleging constitutional violations stemming from in-person sex offense registration requirements. Matthew 25 Ministries is a “not-for-profit corporation that operates an isolated prison-aftercare ministry and community” in Florida known as Miracle Village. Organization brought suit on behalf of those in its care, alleging violations of Ex Post Facto and Due Process provisions. Defendants moved to dismiss.
Holding: United States District Court for the Southern District of Florida dismissed the complaint with prejudice. The court reasoned that the Plaintiff here, Matthew 25 Ministries, lacked standing to sue on behalf of its membership in light of existing 11th Circuit precedent.
