Nature of Case: Defendant was being sentenced federally for a non-sexual offense, though had been convicted more than ten years ago of a sex offense. United States Probation recommended that he be subject to sex offender conditions of supervision, and the Defendant objected.
Holding: District Court held that, due to the fact that the instant offense was not a sex offense and the Defendant’s prior sex offense was more than ten years old, subjecting the Defendant to sex offender conditions of supervision was not appropriate.
