Nature of Case: Appellant was convicted of federal sex offenses and sentenced to a term of imprisonment, along with a ban on him using computers or the internet for ten years following his release. Appellant did not object to these conditions at sentencing, but sought review on appeal nonetheless.
Holding: 5th Circuit Court of Appeals held that a ten year ban on internet and computer use following Appellant’s imprisonment constituted plain error. The Court vacated these conditions and remanded for resentencing.
