Nature of Case: Appellant had been convicted of sex offenses in California and imprisoned for several years. Prior to his release, the state petitioned to detain him as a SVP, which was granted. Some years later, the Appellant sought his release, arguing that his advanced age meant that he was an insufficient risk to continue detaining. The trial court disagreed and ordered his continued commitment and he appealed.
Holding: The California Court of Appeal affirmed, holding that advanced age, standing alone, does not raise sufficient doubt that would render an SVP commitment infirm.
